Terms of Service

1. Who we are

French Fun Flashcards is operated by DeSmedt Games ("we", "us", "our"). By using French Fun Flashcards (the "Service"), you ("you", "user") agree to these Terms.

2. Acceptance

By creating an account or continuing to use the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. You must be of legal age in your jurisdiction, or have permission from a parent or guardian, to use the Service.

3. The Service

French Fun Flashcards lets teachers and parents create flashcard decks, manage up to 25 students per account, and play three included games. Features may change over time.

4. Acceptable use

You agree not to misuse the Service, including: using it unlawfully; infringing intellectual property; sending spam or fraudulent content; uploading malware; probing, scanning, or scraping the Service; or interfering with security features. You are responsible for activity under your account and for keeping your credentials confidential.

5. Payments, subscriptions and billing

French Fun Flashcards Pro is offered as a yearly subscription. Subscriptions renew automatically at the end of each billing period unless cancelled. Payment, billing, taxes, cancellations and refund mechanics are handled by our payment provider, Paddle, and are subject to the Paddle Checkout Buyer Terms.

6. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

7. Intellectual property

The Service, including software, design, branding and documentation, is owned by DeSmedt Games. We grant you a limited, non-exclusive, non-transferable right to use the Service within your subscribed plan. You may not reverse engineer, resell, or redistribute the Service. Content you upload remains yours; you grant us a limited license to host and process it solely to operate the Service.

8. Service level

We do our best to keep the Service running, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties.

9. Suspension and termination

We may suspend or terminate access for: material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. You may stop using the Service at any time.

10. Liability

To the fullest extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential or special damages. Nothing limits liability for fraud, death or personal injury where such liability cannot be excluded by law.

11. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance.
